Legislation should clearly state the duties and powers of local registrars (the civil registrar responsible for the primary registration area), which include recording and registering vital events in compliance with registration laws, and issuing certificates or copies of vital records upon request, without needing approval from the central level.
Does the registrar (local or other level) have the authority to correct minor errors (such as data entry errors and typographical errors)? If yes, are such changes free of charge?

Legislation should authorize the local civil registrar to make minor corrections such as typographical and data entry errors in civil registration records. Such corrections should be free of charge.
The local civil registrar has no authority to correct minor errors on its own. Civil registrars may correct the spelling of surnames and first names on birth certificates only with authorization from the central authority (the Ministry of the Interior or its delegate). For other errors, civil registrars must obtain authorization from the Ministry of the Interior or its delegate, or the courts, depending on the type of error. This is set out in Law 36.21, articles 48 through 52 and implementing Decree 2.22.04.
Does the registrar (local or other level) have the power to add omitted information (such as name of baby, in the case of late naming, and paternity information)?

Legislation should authorize the local civil registrar to add uncontested information such as uncontested paternity information, and add omitted information such as adding or amending the name of a child within a defined time period.
The local civil registrar has no authority to add omitted information on its own. Civil registrars may add surnames and first names on birth certificates only with authorization from the central authority (the Ministry of the Interior or its delegate). For other omissions, civil registrars must obtain authorization from the Ministry of the Interior or its delegate, or the courts, depending on the type of omission. This is set out in Law 36.21, articles 48 through 52 and implementing Decree 2.22.04.
Does the law require the local civil registration office to transmit registration records to the national civil registration authority on a regular and timely basis?

The legislation should set time frames for transfer of information from the local register to the centralized register. The time frames may vary based on policymakers' discretion, depending on whether the system is computerized or non-computerized.
The National Register is the only official source for all civil status records and this register is hosted on the central electronic platform of the Ministry of Interior. All civil status offices within the country are networked with the central electronic register. Therefore, when a vital event is registered at the local level, the data is shared to the national level.

It is important that the law provide clear requirements governing fitness and qualifications of local civil registrars. To prevent corruption, the law should provide that registrars be full-time public service officials, with defined terms of employment and adequate salary level.
Civil registry officials are elected officials - the presidents of municipal and district councils. These civil registry officials are authorized by law to delegate civil registration tasks to other members of the council or civil servants, who can provide services when elected officials are unavailable.
